These Terms and Conditions apply to the MiXR Popworld Midnight Madness holiday voucher prize draw, as set out in the table below (the “Prize Draw”). By entering the Prize draw, you (“Participant”, “you”, “yours”) agree to these Terms and Conditions and to the decisions of the Promoter which are final and binding in all respects. You also agree to any other applicable third-party terms. All applicable laws and regulations apply. Part 1 (Commercial Terms) and Part 2 (Conditions) together are the full terms and conditions that govern the Prize Draw (“Terms and Conditions”).
Capitalised terms used but not defined shall be defined for the purposes of these Terms and Conditions.
PART 1 – COMMERCIAL TERMS

PROMOTER

ENTRY PERIOD
The Prize draw will run from 00:01 on 15/08/25 to 23:59 on 26/09/25 (the “Entry Period”).
WHO IS ELIGIBLE?
To enter the Prize draw, you must be aged 18 years or over and resident in the United Kingdom (excluding Scotland) at the time of Prize Draw entry.
The Winners must have been eligible to enter and must show valid ID showing proof of age at the point of redemption of the Prize. Failure to show valid ID will result in disqualification and you forfeiting your Prize.
HOW TO ENTER?
Internet access and the MiXR app is required to enter. You will be required to have a MiXR account or create one, by downloading the MiXR app on your device through the App Store or Google Play store, and signing up by entering your first name, surname, email address and creating an account to be in the chance to win a Prize, in accordance with clause 2 below.  
Entry into the Prize Draw will be made by purchasing any of the following products in the Promoter’s participating venues during the Entry Period and scanning a valid MiXR card at the point of sale:
1. Smirnoff vodka (including all flavours)
2. Gordon’s Gin
3. Gordon’s Pink Gin
4. Gordon’s 0.0%
5. Captain Morgan (all rum flavours) 
6. Captain Morgan Spiced Gold 0.0%
(“Eligible Products(s)”)
Participants with card linking set up will be automatically entered upon the purchase of an Eligible Product.
Entries received before or after the Entry Period will not be accepted. 
Stonegate accepts no responsibility whatsoever for any entries that were not received for whatever reason. 
Multiple purchases will allow multiple entries. The Prize Draw will count separate transactions, not the number of drinks purchased in any one transaction.  Please drink responsibly.
Only one entry per day per person is permitted during the Entry Period. Multiple entries per day during the Entry Period from the same person will be disqualified.
WHAT IS THE PRIZE?
Participants of the Prize Draw will be in with the chance to win the following Prize:

A Motivates holiday e-voucher with a value of £1,000 (of which 1 is available) (the “Prize”) The Promoter will pay for the Prize as agent for the Winner, who agree to be bound by any terms imposed by third parties including, without limitation, Motivates and any relevant travel or tour operator. The Prize will be emailed to the Winner showing a code to be redeemed online via the website www.motivates.co.uk only.
For website transactions, the holiday e-voucher must have sufficient funds to cover the initial payment due when booking your holiday. The Prize cannot be redeemed over the phone. The Prize cannot be used as payment, or exchanged for, travel money-related products, including currency, travelers’ cheques and prepaid cards.
The expiry date of the Prize will be two years from the date the Winner received the email containing the Prize.  


HOW WINNERS ARE SELECTED
On 29/09/25 (the “Selection Date”) the winning Participant will be drawn using a random computer-generated process on the MiXR app from all entrants who correctly entered the Prize Draw, in accordance with these terms and Conditions, during the Entry Period (the “Winner”). 
HOW IS THE PRIZE COMMUNICATED?
The Promoter will contact the Winner via the MiXR app Prize (or otherwise via email using the email address provided at entry) within 7 business days of the end of the Entry Period to fulfil the Prize.
 
By entering the Prize Draw, Participants acknowledge and agree that, should they win a Prize, the Promoter may share their contact details with the supplier of the Prize for the purpose of fulfilling the Prize. The Promoter will only share the winner's contact details after the Prize has been accepted.  
 
Unless otherwise directed by the Promoter, winners must respond to winning entry correspondence within 48 hours of being notified. If the winner fails to respond within 48 hours of being notified, the Promoter reserves the right to choose a new winner. 

MOP-UP DRAW
If the Prize is not claimed by a Winner as set out above, a mop-up draw will take place on or before 13/10/2025, whereby the winning Participant will be drawn using a random computer-generated process on the MiXR app from all entrants who correctly entered the Prize Draw, in accordance with these Terms and Conditions, during the Entry Period. All unsuccessful entries received within the Entry Period will be entered into the Mop-Up Draw.  
 
Winners of the Mop-Up Draw will be notified via email within 5 days of the Mop-Up Draw and will be required to respond within 48 hours of receipt of the initial notification to confirm eligibility and acceptance of the Prize. 
 
If the Winner of the Mop-Up Draw does not respond to the notification, the Promoter reserves the right to select an alternative Winner from all remaining entries by repeating the Mop-Up Draw, with the original Winner forfeiting their right to the Prize.  
 
The process of the Mop-Up Draw will repeat for one further round. If any Prize remains unclaimed by 26/10/2025, such Prize will become null and void. 


PART 2 - CONDITIONS
1. Prize
1.1 Participants acknowledge and agree that there is no guarantee of winning a Prize. Any Prizes which are redeemable in the Promoter’s venues shall be redeemable (i) subject to stock availability and (ii) in participating pubs owned by The Promoter which are displayed in the MiXR app at the time of entry (as applicable). The Promoter accepts no responsibility if Participants attempt to redeem Prizes at non-participating pubs or if the relevant product is out of stock. 
1.2 Where Prizes cannot be redeemed due to stock availability, the Promoter will substitute this with a suitable alternative (such alternative to be at the Promoter’s discretion). 
1.3 The Promoter reserves the right to substitute a Prize with another prize of equal or greater value at the Promoter’s absolute discretion without giving notice.
1.4 The Prize is non-exchangeable and non-transferable and no cash or other alternatives will be offered.
1.5 The Prize must be treated as cash, and the balance cannot be refunded if it is lost, stolen or destroyed.
1.6 The Prize is not covered by The Association of British Travel Agents’ scheme of financial protection. 
1.7 If it is discovered during Prize verification that a Participant is ineligible to enter, they will be disqualified and all of their entries will be void. 
1.8 The Prizes will be awarded “as is” and the Promoter makes no representation, warranty or condition in respect of any Prize or part thereof. 
1.9 The Winner’s participation in any or all activities for the Prize is voluntary. If the Winner elects not to participate in any or all designated activities for the Prize, the Winner will not be given any compensation.
1.10 Where Prizes include travel: 
1.10.1 the Promoter will be responsible for booking and paying for the Prize on behalf of the winning Participant and any permitted guests. The winning Participant, and any permitted guests, acknowledge and agree that they will be bound by relevant third-party terms including but not limited to, any relevant tour or travel Promoters; 
1.10.2 the winning Participant acknowledges that departure dates and times are subject to availability and at the sole discretion of the Promoter; 
1.10.3 the winning Participant will be responsible for any and all other costs and expenses not listed above (including insurance, expenses and incidentals not mentioned above);  
1.10.4 any additional expenses not covered within the Prize details above are the responsibility of the winning Participant; 
1.10.5 The Prize must be taken or used on the dates specified. The Promoter reserves the right to select alternative winners, should the original winner not validate their identity, age, ability to travel on the fixed trip dates and/or compliance with any relevant immigration criteria.

2. The Prize draw
2.1 Entries that do not comply fully with these Terms and Conditions will be disqualified. The Promoter has sole discretion in determining whether any entries submitted by any person comply with these Terms and Conditions.  
2.2 The Promoter does not accept any responsibility if the winner is not able to take up the applicable Prize.
2.3 The Promoter’s decision is final and binding in all respects on all Participants and no further correspondence will be entered into.
3. Publicity
3.1 By entering the Prize draw, Participants hereby agree to their name, likeness, photograph, voice and video recording, and entry being used by the Promoter for promotional purposes without additional compensation, unless prohibited by law.
3.2 The winners of the Prize Draw further agree to be interviewed in connection with the relevant Prize Draw either in person or via telephone which may be filmed, photographed and/or recorded and the Promoter may use such films, photographs and/or recordings for publicity and PR purposes.
3.3 If you object to any or all or any of your name, likeness, photograph, voice and video recording, and entry being published or made available, please contact the Promoter at competitions@stonegategroup.co.uk.  In such circumstances, the Promoter must still provide the information and winning entry to the Advertising Standards Authority on request.
3.4 Each Participant accepts and acknowledges that if the above consent is withdrawn, the Promoter may not be in a position to remove the photographs, recordings and videos from webpages operated by third parties.
4. Intellectual Property 
4.1 All intellectual property rights in and associated with the Promoter and the MiXR app and brand, are owned by the Promoter and/or the Promoter’s licensors, and Participants have no right to use any intellectual property in and associated with the Promoter and the MiXR app and brand, except in connection with entry to the Prize draw.
4.2 Participants hereby assign to the Promoter any and all intellectual property rights in and associated with the entry to the Prize draw with full title guarantee, such that the Promoter has the full and exclusive right to use, reproduce, or publish such Prize draw entry and accompanying materials for the purposes of administering the Prize draw on its MiXR app; and
4.3 Participant’s hereby irrevocably and unconditionally waive all moral rights in and to the Prize draw entry and any moral rights in accompanying materials otherwise arising in connection with Participant’s Prize draw entry to which Participants may now or at any time in the future be entitled under copyright, right of publicity, right of privacy, and other intellectual property laws applicable in the jurisdiction in which the Prize draw occur.
5. Limitation of Liability
5.1 The Promoter is not responsible for any problems or technical malfunction of any telephone network or lines, computer online systems, servers, or providers, computer equipment, software, failure of any email or entry to be received on account of technical problems or traffic congestion on the internet, or any combination thereof.
5.2 Insofar as is permitted by law, the Promoter and its agents or distributors will not in any circumstances be responsible or liable to compensate the winner or accept any liability for any loss, damage, personal injury or death occurring as a result of taking up a Prize except where it is caused by the negligence of the Promoter or its agents or distributors or that of their employees. Your statutory rights are not affected.
5.3 Insofar as permitted by law the Promoter does not accept any liability for any expense, damage, loss or injury suffered (including loss of opportunity) whether direct, indirect, special or consequential, arising in any way due to entering these Prize draw or taking up a prize. the Promoter is not responsible for any third-party acts or omissions.
6. Data Protection
6.1 In accordance with UK General Data Protection Regulations and the Data Protection Act 2018, the Promoter is the Data Controller of the personal data that is collected for the purposes of administering these Prize draw.
6.2 The Promoter’s lawful basis for processing your personal data for these purposes is performance of a contract.
6.3 For the purposes of administering this processing activity, your personal data will be processed solely in the UK and will not be made available to individuals or companies based outside of the EEA.

7. General
7.1 By taking part in this Prize draw, you are agreeing to be bound by these Terms and Conditions.
7.2 The name and county/town of the winner(s) will be available for one month after the expiry of the Entry Period.  If you wish to find out the identity of the chosen winner(s) please send a stamped addressed envelope to: Stonegate Pub Company Limited, FAO Legal Department, 3 Monkspath Hall Road, Solihull, B90 4SJ.
7.3 These Terms and Conditions prevail in the event of any inconsistency with any other communications from the Promoter, including advertising and promotional material.
7.4 The Promoter reserves the right to modify, cancel or amend these Prize draw or to amend these Terms and Conditions in whole or in part where it becomes necessary to do so and without prior notice.
7.5 Winners shall not carry out or promote the goods and services of the participating venues in any way, including, but not limited to, advertising or posting about alcohol.
7.6 This Prize draw is not in any way sponsored, endorsed or administered by, or associated with Instagram, Twitter, Facebook or any other social media platform.  Participants acknowledge that Instagram, Twitter, Facebook or any other social media platform shall not have any liability to them in connection with the Prize draw.
7.7 These Terms and Conditions are governed by English law and the Courts of England and Wales will have exclusive jurisdiction.

The choice of game and prize will be at the sole discretion of the venue staff of the particular participating venue. Participants must check which game and corresponding prize is available at the participating venue before entering a Prize Draw game.
By entering this Prize draw, you agree to be bound by these Terms and Conditions and that our decision is final and binding in all matters relating to these Prize draw.  If you fail to comply with these Terms and Conditions your entry will automatically be void.
WHAT ARE THE PRIZES?
Participants of the Prize Draw will be in with the chance to win a range of Prizes. Examples may include the following:

Drinks Prizes: A VIP table + spirit bottle, a £25 Bar Tab, a free shot voucher, or free drink voucher. The prizes available vary per venue and shall be at the sole discretion of the venue staff. 
The staff of the relevant participating venue shall provide each Winner with details of how to redeem the prize.

HOW WINNERS ARE SELECTED
During the Entry Period, Participants of the Prize Draw will be selected as follows: 

If the Prize Draw game is one based on skill, during the Entry Period, Participants will be selected as the winners based on their skill, judgement or performance in that particular game from all entrants who entered that Prize Draw game, in accordance with these Terms and Conditions, during the Entry Period. 

If the Prize Draw game is a game of chance, during the Entry Period, Participants will be drawn using a random computer-generated process on the MiXR app or a random in person process in the participating venue from all entrants who correctly entered that Prize Draw game, in accordance with these Terms and Conditions, during the Entry Period (in each case “Winners”).

PART 2 - CONDITIONS
1. Prizes
1.1 Participants acknowledge and agree that there is no guarantee of winning a Prize.
